Terms of Service

Your account

You are responsible for keeping your login credentials confidential and for any activity that happens under your account. You must be at least 18 years old to create an account.

Acceptable use

You agree not to:

• Use BuildScape to violate any law or infringe anyone's rights.
• Attempt to disrupt the service, reverse-engineer it, or gain unauthorized access to other accounts.
• Upload malicious content or content you don't have the right to share.
• Use AI-generated scope notes as legally binding advice — always review before sending to clients.

Your content

You own the estimates, customer records, and other data you put into BuildScape. You grant BuildScape a limited license to store and process that data solely to operate the service for you.

Our intellectual property

BuildScape (including the software, source code, user interface, designs, logos, brand, documentation, and any templates or content we provide) is owned by BuildScape and its licensors and is protected by copyright, trademark, and other laws. Nothing in these terms transfers any ownership of BuildScape to you.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use BuildScape for your internal business purposes while your account is in good standing. You may not copy, modify, resell, sublicense, or create derivative works from BuildScape, and you may not remove or obscure any proprietary notices.

Payments, billing & subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns, refunds, chargebacks, billing, invoicing, and collection of applicable sales tax or VAT.

Paid plans are billed on a recurring basis (monthly or annually, depending on the plan you select) and renew automatically at the end of each billing period at the then-current price until cancelled. You can cancel at any time from your account settings or via paddle.net; cancellation stops future renewals and you keep access until the end of the current billing period.

Fees, taxes, payment terms, currency conversion, and buyer protections are governed by Paddle's Checkout Buyer Terms. Refunds and cancellations are handled under our Refund Policy and Paddle's Refund Policy.

Availability & warranty

BuildScape is provided "as is." We work hard to keep it reliable, but we don't guarantee uninterrupted access, freedom from bugs, or fitness for a particular business decision. Estimates and scope notes are tools — you are responsible for verifying numbers before quoting a client.

Limitation of liability

To the fullest extent allowed by law, BuildScape and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost revenue, lost business, lost data, or the cost of substitute services — even if we've been told such damages were possible.

Our total combined liability for any claim relating to BuildScape is capped at the greater of (a) the amount you paid us for the service in the twelve (12) months before the event that gave rise to the claim, or (b) US $100.

Some jurisdictions don't allow certain limitations on liability, so parts of this section may not apply to you. In that case, our liability is limited to the smallest amount the law permits.

Termination

You may cancel your account at any time from within the app or by contacting us. We may suspend or terminate your account if you materially violate these terms, use BuildScape in a way that creates legal or security risk, or fail to pay fees when due. We will give you reasonable notice where practical.

When your account ends, your license to use BuildScape ends immediately. We will retain and then delete your business data according to the retention timelines described in our Privacy Policy. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will remain in effect.

Governing law & venue

These terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. You and My Guy Concepts Limited agree that any dispute arising out of or relating to these terms or your use of BuildScape will be brought exclusively in the courts of England and Wales, and both sides consent to the personal jurisdiction of those courts.

If the law where you live requires a different governing law or forum, that mandatory law controls to the extent required.

Changes

We may update these terms as the product evolves. Material changes will be announced by email or an in-app notice.
